Terms of Service

Welcome to Lapty ("Lapty", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Lapty website, dashboard, Windows VPS services, Linux IP services, proxy/IP services, reseller services and related products (collectively, the "Services").

By creating an account, purchasing a Service, accessing our platform or using any Service, you agree to these Terms. If you do not agree with these Terms, you must not use Lapty.

1. Eligibility

You must provide accurate and complete information when creating an account.

You represent that:

  • You are legally capable of entering into a binding agreement.
  • The information provided to Lapty is accurate and current.
  • You will keep your account credentials secure.
  • You will not create accounts using false, misleading or stolen information.
  • You will comply with all applicable laws and regulations.

Lapty may request additional information or verification where reasonably necessary to prevent fraud, abuse or unlawful activity.

2. Services

Lapty may provide:

  • Windows VPS services;
  • Linux IP and Proxy services;
  • Dedicated or shared IPv4/IPv6 addresses;
  • Proxy IP services;
  • Datacenter and other IP-based services where specifically advertised;
  • VPS and proxy reseller services;
  • Bandwidth, storage and related infrastructure;
  • Management, automation or API services;
  • Other infrastructure-related products.

The exact specifications, limitations, locations, bandwidth allowances, operating systems and features of a Service are determined by the applicable product page or order.

Lapty may modify, replace or discontinue particular products or infrastructure where reasonably necessary.

3. Account Security

You are responsible for all activity performed through your account. You must:

  • Keep your password confidential;
  • Use appropriate security measures;
  • Immediately notify Lapty if you suspect unauthorized access;
  • Not share your account unless the purchased Service explicitly permits it.

You are responsible for activity performed by your customers, employees, contractors or other persons to whom you provide access.

4. Acceptable Use Policy

Lapty's infrastructure may not be used for unlawful, abusive, fraudulent, malicious or harmful activities. Prohibited activities include, without limitation:

Cyber Abuse

  • Unauthorized access to computers, servers or networks;
  • Unauthorized hacking or attempted hacking;
  • Exploiting vulnerabilities without authorization;
  • Malware, ransomware, spyware or botnet operations;
  • Credential theft;
  • Keylogging;
  • DDoS or other unauthorized network attacks;
  • Port scanning intended to facilitate unauthorized access;
  • Brute-force attacks;
  • Distribution of malicious software.

Fraud and Abuse

  • Phishing;
  • Fake login pages;
  • Payment fraud;
  • Identity theft;
  • Financial scams;
  • Fake investment or banking websites;
  • Fraudulent advertising;
  • Account takeover;
  • Card testing;
  • Unlawful chargeback abuse.

Spam

You may not use Lapty infrastructure for unsolicited bulk email, spam campaigns, email harvesting, purchased or scraped mailing lists, unsolicited SMS or messaging campaigns, or mail-server abuse.

Illegal Content & Intellectual Property

You may not use Lapty Services to host, distribute, facilitate or promote content or activity that violates applicable law, nor knowingly distribute copyrighted material without appropriate authorization.

Proxy/IP Abuse

Proxy and IP Services may not be used for fraud, credential attacks, account creation abuse, circumventing security controls, attacking third-party systems, spam, illegal scraping, or circumventing bans or access restrictions for malicious purposes.

5. VPS Usage

You are responsible for everything installed, hosted or executed on your VPS, including operating-system configuration, software licensing, application security, backups, password management, firewall configuration, user accounts, and data stored on the VPS.

Unless explicitly included, Lapty does not guarantee backups or data recovery after deletion, suspension, termination, hardware failure or other infrastructure incidents.

6. Windows VPS

Windows VPS products may use Microsoft software subject to Microsoft's licensing requirements. You must not circumvent Windows licensing, activate unauthorized copies, modify licensing mechanisms, share license keys, or use the VPS in violation of applicable Microsoft licensing terms. Lapty may suspend a Windows VPS where continued operation creates a licensing or legal risk.

7. Proxy and IP Services

IP addresses are infrastructure resources and are not guaranteed to remain permanently assigned unless expressly stated otherwise. Lapty may replace an IP address because of abuse reports, IP reputation issues, blacklisting, upstream-provider requirements, network changes, security incidents, or availability issues. An IP being blocked by a third-party website does not automatically mean that Lapty has breached its obligations.

8. Reseller Services

Customers purchasing reseller services are responsible for their own customers and users. Resellers must ensure their customers comply with these Terms, respond to abuse complaints, and prevent customers from using Lapty infrastructure for prohibited activity. A reseller may not represent itself as Lapty without written authorization. Lapty may suspend a reseller account if its downstream customers repeatedly cause violations.

9. Resource Abuse

Customers must not intentionally consume resources in a manner that negatively affects infrastructure or other customers (e.g. excessive CPU consumption, disk abuse, network flooding, excessive connection creation). Lapty may throttle, suspend or terminate affected Services when necessary to protect infrastructure.

10. Payments

Services are generally prepaid unless otherwise agreed. You authorize Lapty or its payment processor to charge the selected payment method for applicable purchases and recurring subscriptions. Prices may change; changes to recurring pricing will generally apply to future billing periods.

11. Automatic Renewal

Where automatic renewal is enabled, the Service may renew automatically at the end of its billing period. You are responsible for cancelling automatic renewal before the next billing cycle if you do not wish to continue the Service.

12. Suspension

Lapty may suspend a Service where reasonably necessary because of non-payment, fraud, abuse, security threats, violation of these Terms, illegal activity, abuse complaints, excessive resource usage, upstream-provider requirements, or law-enforcement requests.

13. Termination

Lapty may terminate an account for serious or repeated violations of these Terms. You may terminate your account by discontinuing use of the Services and cancelling active subscriptions. Upon termination, access to Services may cease immediately.

14. Uptime and Maintenance

Lapty aims to provide reliable infrastructure but does not guarantee uninterrupted availability unless a specific SLA expressly applies. Downtime may occur because of scheduled maintenance, emergency maintenance, hardware failure, network failure, upstream-provider outages, DDoS attacks, or force majeure.

15. Backups

Unless expressly included in your Service, Lapty does not guarantee backups. Customers should maintain independent backups of important data.

16. Abuse Reports

Lapty may investigate credible abuse reports. Customers must cooperate with legitimate abuse investigations.

17. Intellectual Property

The Lapty name, logo, website, software, interface, branding and proprietary materials remain the property of Lapty or its licensors. You receive only the limited rights necessary to use the Services.

18. Third-Party Services

Some Services may depend on third-party providers. Lapty is not responsible for failures caused solely by third-party services outside Lapty's reasonable control.

19. Disclaimer

Except where expressly provided otherwise, Services are provided on an "as available" and "as is" basis without warranties of any kind.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Lapty shall not be liable for indirect, incidental, special, consequential or punitive damages. Lapty's aggregate liability relating to a Service shall not exceed the amount actually paid by the customer to Lapty for that Service during the 90 days immediately preceding the event giving rise to the claim.

21. Indemnification

You agree to indemnify and hold harmless Lapty, its officers, employees, contractors and service providers from claims, damages, liabilities, losses and expenses arising from your use of the Services or violation of these Terms.

22. Changes to These Terms

Lapty may update these Terms from time to time. Updated Terms will be published on the Lapty website.

23. Governing Law

These Terms shall be governed by the laws of India, unless applicable law requires otherwise. Subject to mandatory consumer-protection rights, disputes shall be subject to the jurisdiction of the competent courts in India.
